The Legal Requirements for Managing Asbestos Waste

  • Always store asbestos waste on your premises in an environmentally safe manner. This could include sealing it in heavy-duty plastic and wetting it down before transporting it.

  • Bonded asbestos material has to be securely packaged at all times. This is any material, besides friable asbestos material, that contains asbestos.
  • If you want to remove more than 10 square meters of bonded asbestos, or friable asbestos, from your house, engage the services of a licenses asbestos removal contractor to do the job. As the owner of the waste, you need to ensure that the asbestos is disposed of legally. To make sure this is done, ask your contractor for a copy of the disposal receipt.
  • It is illegal to recycle, re-use or illegally dump any asbestos products.
  • It is also illegal to dispose of asbestos waste materials in domestic garbage bins.
  • Keep friable asbestos in a sealed container. This is any material that contains asbestos and presents itself in the form of a powder or substance that can be crumbled or reduced to powder by hand.

Breaking the Law: There Are Penalties

There are indeed penalties for mishandling and illegally removing asbestos. Recently, a Bay City contractor was found guilty of failing to remove asbestos before demolishing a building. He also failed to wet down and keep the asbestos wet until properly disposing of it and failed to ensure that a trained person handled the procedures for removing asbestos.
